1. Acceptance of Terms

By accessing or using Boston Property Navigator ("the Platform", "we", "our", or "us"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this Platform.

These Terms of Service apply to all users of the Platform, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

2. Service Description

Entertainment & Educational Platform

Boston Property Navigator is designed for entertainment, educational exploration, and general information purposes only. All features provide hypothetical scenarios and thought experiments—NOT professional advice.

Boston Property Navigator provides:

  • AI-Powered Property Analysis: Automated property investment scenarios and educational risk assessments
  • Town Vibes: Crowdsourced community perception data and voting system
  • Market Intelligence: Real estate data, sales trends, and neighborhood analysis
  • School Rankings: Educational data and school district information
  • Property Reports: Generated analysis reports and hypothetical investment projections
  • Chat Interface: AI-assisted real estate information and educational content

All services are provided for entertainment, educational exploration, and informational purposes only and do not constitute professional real estate, financial, legal, or investment advice.

2.5 Arm's-Length Relationship / No Agency

The relationship between you and Boston Property Navigator is strictly contractual and arm's-length. This relationship:

  • Does NOT create any fiduciary relationship
  • Does NOT create any agency relationship
  • Does NOT create any attorney-client relationship
  • Does NOT create any advisor-client relationship
  • Does NOT impose any duty on us to act in your best interest

You acknowledge that we have no special duty of care, loyalty, or confidentiality to you beyond providing access to this entertainment and information platform.

2.6 No Brokerage Activity / UPRE Compliance

We Explicitly DO NOT Engage in Licensed Real Estate Activity

We do NOT engage in any activity requiring real estate licensure, including:

  • Listing, selling, or negotiating property transactions on behalf of others
  • Providing transaction-specific contract guidance or negotiation tactics
  • Offering property valuations or appraisals for compensation
  • Receiving compensation contingent upon property transactions
  • Managing or facilitating property showings or access
  • Providing specific offer strategies for your individual transaction

Our platform provides ONLY: General market education, publicly available data aggregation, and entertainment content.

2.7 No Legal Practice / UPL Compliance

We Explicitly DO NOT Engage in the Practice of Law

We do NOT engage in the practice of law, including:

  • Interpreting contract terms or legal obligations for your specific situation
  • Providing legal opinions on property rights, disputes, or disclosure requirements
  • Drafting or modifying legally binding documents
  • Advising on jurisdiction-specific legal requirements or statutes
  • Representing you in any legal matter or transaction

All content is general information only. You MUST consult a licensed real estate attorney in your jurisdiction for legal guidance on any property transaction or real estate matter.

3. User-Generated Content License

By submitting, posting, or contributing any content to the Platform (including but not limited to Town Vibes votes, tags, comments, or feedback), you grant Boston Property Navigator:

  • A perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content
  • The right to use your contributions in any format, medium, or technology now known or later developed
  • The right to sublicense these rights to third parties
  • All contributions become the property of the Platform immediately upon submission

You will not receive any compensation for user-generated content. You represent and warrant that you own or have the necessary rights to grant this license.

4. Town Vibes Specific Terms

4.1 Crowdsourced Data Disclaimer

IMPORTANT: Town Vibes data is user-generated and crowdsourced

  • All voting data, tags, and perceptions are subjective opinions from individual users
  • No guarantee of accuracy, completeness, or reliability
  • Data may contain errors, biases, or offensive content
  • Do not rely on Town Vibes data for real estate decisions without independent verification
  • The Platform acts as a distributor, not publisher or editor of user content

4.2 Voting Terms

  • Rate Limiting: Maximum 5 votes per town per session; 50 total votes per session per day
  • Anonymous Voting: Votes are anonymous but IP addresses are hashed for abuse prevention
  • Vote Ownership: All votes become Platform property immediately upon submission
  • No Deletion: Votes cannot be deleted once submitted
  • Moderation: Platform reserves the right to remove votes without notice

4.3 Prohibited Content

Users may not submit content that is:

  • Defamatory, libelous, or false
  • Threatening, harassing, or abusive
  • Obscene, vulgar, or offensive
  • Discriminatory based on race, religion, gender, or other protected characteristics
  • Commercial promotion or spam
  • Unlawful or encouraging illegal activity

4.4 Content Moderation Rights

The Platform reserves the right to:

  • Remove any votes or content without notice or explanation
  • Suspend or ban users who violate content standards
  • Modify or edit user contributions for formatting or compliance
  • Make final decisions on content without appeal

5. AI Analysis Disclaimers

AI recommendations are estimates and predictions, not guarantees

  • No Guarantee of Accuracy: AI analysis is based on algorithms and historical data; actual results may vary significantly
  • Not Professional Advice: AI recommendations do not constitute professional real estate, financial, or investment advice
  • No Performance Guarantee: Past performance does not guarantee future results
  • Market Volatility: Real estate markets are subject to change; predictions may become outdated
  • Independent Verification Required: Always verify AI analysis with professional consultation
  • Errors Possible: AI systems may produce errors, inconsistencies, or incorrect recommendations

The Platform's AI analysis should be considered one data point among many in your decision-making process, not the sole basis for investment decisions.

6. Limitation of Liability

6.1 "AS IS" Service

The Platform and all services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of accuracy, completeness, or reliability
  • Warranties of merchantability or fitness for a particular purpose
  • Warranties of non-infringement
  • Warranties of uninterrupted or error-free service

6.2 No Liability for Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Boston Property Navigator and its officers, directors, employees, or agents shall not be liable for any:

  • Direct damages: Loss of profits, revenue, or business opportunities
  • Indirect damages: Consequential, incidental, or special damages
  • Investment losses: Financial losses from real estate decisions based on Platform data
  • Data accuracy: Errors, omissions, or inaccuracies in crowdsourced or AI-generated content
  • Service interruption: Downtime, technical issues, or data loss
  • Third-party content: User-generated content or external links

6.3 Maximum Liability

In jurisdictions that do not allow the exclusion or limitation of liability, our liability shall be limited to the maximum extent permitted by law. In no event shall our total liability exceed $100 USD or the amount you paid to access the service (if any), whichever is less.

6.4 User Assumption of Risk

You acknowledge and agree that:

  • Real estate investment involves substantial risk
  • You assume all risk associated with using Platform data
  • You are solely responsible for your investment decisions
  • You will not hold the Platform liable for any losses

All analyses, scenarios, and recommendations are for entertainment and educational purposes only—they are hypothetical examples and thought experiments, not professional guidance for your specific situation.

All content, analysis, and recommendations provided by Boston Property Navigator are for entertainment, educational exploration, and informational purposes only. The Platform does NOT provide:

You Must Do Your Own Research

No fiduciary, advisory, or professional relationship is created by using this Platform. You are solely responsible for conducting your own due diligence and engaging qualified, licensed practitioners.

8. Intellectual Property

8.1 Platform Ownership

The Platform and its original content (excluding user-generated content), features, and functionality are owned by Boston Property Navigator and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8.2 Restrictions

You may not:

  • Reproduce, distribute, or create derivative works without permission
  • Scrape, harvest, or extract data using automated tools
  • Reverse engineer or decompile the Platform
  • Remove or modify copyright notices or proprietary marks
  • Use the Platform for commercial purposes without authorization

8.3 Attribution

If you display or reference Platform data externally, you must provide clear attribution with a visible hyperlink to the Platform.

9. Service Modifications and Availability

9.1 Right to Modify

We reserve the right to:

  • Modify or discontinue the Platform at any time without notice
  • Change features, functionality, or content
  • Update these Terms of Service at our discretion
  • Modify pricing or introduce fees for services

9.2 No Uptime Guarantee

We do not guarantee that the Platform will be available at all times. The Platform may experience:

  • Scheduled or unscheduled downtime
  • Technical issues, bugs, or errors
  • Service interruptions or slowdowns
  • Data loss or corruption

We are not liable for any inconvenience, loss, or damage resulting from service unavailability.

9.3 Data Changes

10. Governing Law and Jurisdiction

10.1 Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law provisions.

10.2 Jurisdiction

Any legal action or proceeding arising out of or relating to these Terms or the Platform shall be brought exclusively in the state or federal courts located in Massachusetts, and you consent to the personal jurisdiction of such courts.

10.3 Dispute Resolution

For disputes under $10,000, you agree to binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration shall be conducted in Massachusetts.

10.4 Class Action Waiver

You agree to bring claims only in your individual capacity and not as a plaintiff or class member in any class or representative action. Class arbitrations and class actions are not permitted.

10.5 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
