By participating in Town Vibes, you agree to this User Agreement. Town Vibes data is crowdsourced and subjective. Do not rely on this information for real estate decisions without independent verification and professional consultation.

1. Acceptance of Terms

By clicking "Submit Vote" or participating in any way in the Town Vibes feature, you acknowledge that you have read, understood, and agree to be bound by this Town Vibes User Agreement and our general Terms of Service.

If you do not agree with these terms, you must not participate in Town Vibes voting.

2. What is Town Vibes?

Town Vibes is a crowdsourced community perception tool that allows users to vote on descriptive tags for Boston Metro area towns. The system aggregates votes to create "word clouds" showing how the community perceives different towns.

Key Characteristics:

  • User-Generated: All data comes from individual user votes, not professional analysis
  • Subjective: Represents personal opinions and perceptions, not objective facts
  • Anonymous: Individual votes are not linked to identifiable users
  • Dynamic: Data changes as more users vote
  • Unverified: No fact-checking or professional validation of votes

3. License Grant & Content Ownership

3.1 Perpetual License

By submitting votes, tags, or any content through Town Vibes, you grant Boston Property Navigator:

  • A perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, distribute, and display your votes
  • The right to aggregate and analyze your votes with other user data
  • The right to display vote results publicly on the platform and in reports
  • The right to use voting data for research, analysis, and platform improvement

3.2 No Ownership Rights

You acknowledge and agree that:

  • Your votes become platform property immediately upon submission
  • You have no ownership rights to aggregated voting data
  • You will receive no compensation for your contributions
  • You cannot delete or retract votes once submitted

3.3 Representations and Warranties

By voting, you represent and warrant that:

  • You have the right to submit your votes
  • Your votes do not infringe on third-party rights
  • Your votes comply with all applicable laws
  • You are at least 18 years of age

4. Data Accuracy & Reliability Disclaimer

NO GUARANTEE OF ACCURACY

4.1 Crowdsourced Data Limitations

You acknowledge and understand that Town Vibes data:

  • Is subjective: Represents personal opinions, not objective facts
  • May be inaccurate: Contains errors, outdated information, or misconceptions
  • May be biased: Reflects the demographics and perspectives of voters
  • May be incomplete: Not all towns have equal vote representation
  • May contain stereotypes: Can perpetuate community stereotypes or generalizations
  • May be offensive: Could include content some users find offensive
  • Is unverified: No professional review or fact-checking process

4.2 No Reliance

DO NOT rely on Town Vibes data for:

  • Property purchase decisions
  • Investment analysis
  • Neighborhood selection
  • School district evaluation
  • Safety assessments
  • Demographic research

4.3 Independent Verification Required

Always verify town characteristics through:

  • Personal visits and observation
  • Professional real estate agents
  • Official town statistics and data
  • School district websites and ratings
  • Police department crime statistics
  • Multiple independent sources

5. Voting Rules & Rate Limits

5.1 Rate Limits

To prevent abuse and ensure data quality, we enforce the following limits:

  • 5 votes maximum per town per session
  • 50 votes maximum per session per day
  • 10-second minimum between votes
  • 10 tags maximum per vote

5.2 Anonymous Voting

  • Votes are anonymous - not linked to your identity
  • IP addresses are hashed (SHA256 encryption) for abuse prevention
  • Session tokens are generated for rate limiting purposes
  • We cannot identify which user voted for which tags

5.3 Vote Permanence

  • Votes cannot be deleted once submitted
  • Votes cannot be edited after submission
  • You cannot identify or remove your specific votes

6. Prohibited Content & Conduct

6.1 Prohibited Content

You may NOT submit votes or content that is:

  • Defamatory or Libelous: False statements that harm reputation
  • Threatening or Harassing: Content that threatens or intimidates
  • Obscene or Vulgar: Sexually explicit or excessively profane content
  • Discriminatory: Content targeting protected characteristics (race, religion, gender, sexual orientation, disability, etc.)
  • Hate Speech: Content promoting hatred or violence
  • Commercial Spam: Promotional content or advertising
  • Unlawful: Content that violates any law or regulation
  • False or Misleading: Intentionally deceptive information
  • Invasion of Privacy: Personal information about individuals

6.2 Prohibited Conduct

You may NOT:

  • Manipulate voting through automation, bots, or scripts
  • Coordinate voting campaigns to skew results
  • Attempt to circumvent rate limits
  • Use multiple sessions or devices to exceed vote limits
  • Reverse engineer or tamper with the voting system
  • Harass or target specific communities

6.3 Consequences of Violations

Violations of these rules may result in:

  • Immediate removal of your votes
  • Suspension of voting privileges
  • IP address blocking
  • Permanent ban from the platform
  • Legal action (if applicable)

7. Content Moderation Rights

7.1 Platform Rights

Boston Property Navigator reserves the right to:

  • Remove any votes without notice or explanation
  • Modify vote aggregations to maintain data quality
  • Suspend or ban users who violate guidelines
  • Change voting rules at any time
  • Discontinue Town Vibes at any time

7.2 No Editorial Control

While we reserve moderation rights, the Platform acts as a distributor, not a publisher or editor of user content. We do not endorse, verify, or take responsibility for user-generated votes.

7.3 No Appeal Process

Moderation decisions are final and not subject to appeal. We are not obligated to provide explanations for removed content or suspended accounts.

8. Limitation of Liability

BY USING TOWN VIBES, YOU AGREE THAT:

8.1 No Liability for Data Accuracy

The Platform is NOT LIABLE for:

  • Inaccurate, false, or misleading voting data
  • Offensive, defamatory, or inappropriate user content
  • Decisions made based on Town Vibes data
  • Financial losses from real estate decisions influenced by Town Vibes
  • Reputational harm to towns or communities from negative votes

8.2 No Liability for Service Issues

The Platform is NOT LIABLE for:

  • Downtime or unavailability of Town Vibes
  • Loss of voting data or vote counts
  • Technical errors or system malfunctions
  • Changes to voting features or discontinuation

8.3 User Assumption of Risk

You acknowledge and accept that:

  • You use Town Vibes at your own risk
  • You assume all responsibility for decisions influenced by Town Vibes data
  • The Platform provides Town Vibes "AS IS" without warranties

9. Changes to This Agreement

We may update this Town Vibes User Agreement at any time. Changes will be posted on this page with an updated "Last Updated" date.

Your continued participation in Town Vibes after changes are posted constitutes acceptance of the updated agreement.

10. Governing Law

This Town Vibes User Agreement is governed by the laws of the Commonwealth of Massachusetts, United States and is subject to our general Terms of Service.

Agreement Acknowledgment

By clicking "Submit Vote" in Town Vibes, you acknowledge that you have:

  • Read and understood this entire Town Vibes User Agreement
  • Agreed to grant perpetual license to your votes
  • Acknowledged that data is crowdsourced and not guaranteed accurate
  • Agreed not to rely on Town Vibes data for real estate decisions
  • Agreed to follow all content and conduct guidelines
  • Accepted all limitations of liability
